    1099-misc on cpt
    Hi,
    I used to work at a web 2.0 company while I was on f1-cpt. The employer gave me a 1099-misc. is it OK to get a 1099 on f1? If yes, what kind of deductions can I get considering I was married in dec 2006? If no, what can I do?

    No, your company should NOT have paid you under Form 1099-MISC.

    However, that s NOT your fault, so report the income using Schedule C and Form 1040NR.

    You should be able to claim your wife as a dependent if you ended the year under the F-1 visa.

    If you ended under an H-1B visa, you MAY want to file jointly, but do so makes you liable for a 15.3% self-employment tax on your Form 1099-MISC income. Because of that, it may make more sense to file Form 1040NR and just claim your wife as a dependent.
