    My husband just got a call from Capital Management (anyone heard of them) threatening filing a summons tomorrow at noon. This is an old credit card debt about 3 years old and should be coming off my husbands credit report in about 5 months is what I have been told. They are threatening garnishment or a levy on our home, neither of which I think they can get according to what I have read about North Carolina Law. The law here is that only the government, child suport, alimony, etc can get a garnishment. He used scare tactics which I bought but think I will call them tomorrow after I have heard from people here.

    There are states that don't allow garnishments. I'll take your word for it that NC is one. Cool for you. However, with a judgment they can attach your/his bank accounts, ruin his credit, and generally cause you a lot of trouble. Plus, they'll add attorney's fees and court costs which could very well DOUBLE the amount of the debt.

    Look, I hate these scumbags. But, if they've been given a hammer, by your husband himself, for failing to handle his responsibility, you'd better believe they'll use it.

    IF he has some cash to negotiate with, I certainly would.
