I moved in with my roommate nine months ago when I had ankle monitor I gave her name and address and all the info to the Probation Office they've been here several times for my home visits and now they looked up online and it says that she had a deffered felony from 1991 and now I have to move out in one week I complied with all the rules like I was supposed to and gave them her info now because they didn't do their job I have to move out lt s a deferred felony which she completed so shouldn't it not even be able to be on her rec o rd

Yes, the PO can do almost anything, sadly. A lot of it is unfair. But being on probation is considered sort of a weekend pass from prison, with all the same unfairness you got in there.
We don't know the terms of your probation. Who knows what they know about deferred? Who's going to explain it to them? It won't do any good for you to try, and your roommate doesn't seem to have her dismissal papers.
Ask if you can have another week for her to get a copy?

Yeah you got to move... and yes they can make you, but life's not fair for anyone... it is what it is and YOU agreed to it. Look at it this way... most of us have underwear older than the amount of time you will have to live under those rules. The more you huff and puff and stomp your feet, the longer its going to seem like before its over. Meaning..its only as rough as you make it.

She has some right to stomp her feet, but can't of course.

The key here is that your roommate was never a felon. If it's just felons you can't live with, someone has to convince your PO of that, preferably someone other than you. WITH papers, AND some legal help!

Yeah she could try that and maybe win... and her PO could take exception to it and crack down even harder over every little thing they can and then some... so its a catch 22 situation here... lot of ways this can turn out far worse... not many where it will turn out favorable. I don't think it's a battle worth the potential cost (not just in the monetary sense) for the amount of time involved... keeping a low profile might work out better in her favor. But its her choice to make.

I don't disagree with her on the principle....I just think its a case of choosing ones battles very carefully.

It is not the PO job to look up the criminal history of your room mate, did you tell the PO that your room mate had this arrest and felony on their record. You are normally required to, not just let them look it up.

And yes, you have to move, either on your own, or the PO can move you back to jail.

I know I need to choose my battles and this is one I probably won't win. Its just really frustrating .im finally at a good spot in my life. Imdoing everything I'm supposed to do. I got a job I I go to work everyday where I've worked my way from server to asst manager.my roommate takes me to work( ihavent been able to get a car yet.. almost)and it's a safe comfortable plce wher ibcan stay sober.. now they want me to take a huge step backwards and go to a sober house and liv with several felonsbe exposed to there problems and pay fees I cant afford .iknow cause that is where I was I don't want to be exposed to all the drugs the struggles and I don't have any choice though guess I would like tto think that my success would be a factor butvits not I'm real sad about it

Fr_Chuck! The roommate is NOT A FELON. A deferred felony that goes through steps for dismissal is NEVER a felon.

Never be afraid to state your case, and better with a good lawyer on your side. At least consult with one before your deadline is up. Being proactive in your own behalf is better than just being sad.
