    Validating legal judgements
    Hi,

    I am in the process of re-financing my mortgage and for the first time ever I have discovered that there is a judgement against my name (name only, not my property) and my ex husband's name for an unpaid rent debt of 4,000.

    This rent was SUPPOSED to be paid by my ex during our separation 19 1/2 years ago. Have no idea if it ever was after the judgement was entered (they were pretty mad at the time and my ex was supposed to take care of it - he had the cash in his hand)

    Anyway, my question is:

    My mortgage company is getting NO RESPONSE after trying for days now to contact the attorney on the judgement.

    We cannot find the people who entered the judgement.

    SO - do I have the option to have this dismissed since I cannot get it validated?

    AND - what are my validation options? What proof on their end would they still have to show now to validate this debt? I mean, for all I know if we were able to locate them and they were given that cash they could just say they never got it - I never signed anything saying I owe them 4,000.

    PS: Not trying to not pay my bills. It's just that I was left with so much debt that he was supposed to be half responsible for that I had to just pay myself to get it done, not to mention the thousands in child support he owes - it just burns me that I'll get stuck with this too after all this time.

    Any advice appreciated!! Bottom line is I would love to be able to just void this judgement since no lawyer response and no people located so no validation can be provided.

    Which court issued the judgment, call the clerk office and ask them to pull the file. If it is listed, it is most likely valid.

    If this is from almost 20 years ago, then just ask the credit bureaus to remove it. They will request validation. If it is from that long ago it has to have been renewed at least once. Since this is a refi, I can't really see the bank making a big deal of it.
