    Resident/Non-Resident alien status
    Hi,
I came to US in Feb-2006 for the first time and staying here until now on L1-VISA. My wife and child are also staying with me on L2 visa. My wife does not work in USA.

    My Queries?

    1. What is my status in US to be considered? Am I non-resident alien or resident alien or resident alien if joint filing?

    2. Can I apply for SSN for wife and child as they are in L2?

    3. Since I don't have SSN/ITIN for my wife & Kid, can I file W7 for them along with my TAX filing?

    4. I came to know that I can apply for CA-state tax only after getting ITIN. Is that true? If that is the case, how can I extend my State Filing?

    5. How do I get benefit on declaring my dependents(wife&child)?

    Thanks,

    1) If you file jointly with your wife, you are BOTH treated as resident aliens for the entire year of 2006.

2&3) No on the SSN; you need to get ITINs for your wife and child, suing Form W-7.

    4) If you filed a federal extension request, you are covered. If you have a refund coming from California, there are no penalties for filing late.

    5) Each exemption is worth a $3,300 deduction, plus your wife gets her own $5,150 standard deduction.
