Am I NR and can I file married filing jointly ?
    Hi,

I am an India, came to US on L1 in October. My wife came on L2 and she has just applied for SSN. My wife doesn't work.

    My questions are :
    - For tax return purpose am I Resident or Non Resident ?
    - Can I file as Married filing jointly ?
    - which form should I fill to file US tax return. (if you can let me know all the forms it will be of great help.

Also I visited US on B1, so does that has any impact on my tax return for 2006 ?
    - in 2005 for 5 months
    - in 2006 for 2 months

    Thanks
    Firoz

You can file jointly with your wife and you BOTH are treated as resident aliens for ALL of 2006.

But this requires you declare your home country income on your U.S. tax return.

    File Form 1040.

The B-1 visa has no effect on your tax return.
