    OPT-HI change
    Hi,
I moved from anF1(OPT) status to H1 in May of 2006. I'm a bit confused about the status I should be filing my taxes under.
    Can someone help out?
    Thanks.

It depends somewhat on when your F1 began. From the facts provided, it looks most likely that you are a dual status alien. This is a little bit complex in terms of what you should file. Check Publication 519 for details or hire a tax professional to do it for you.

My F1 began in January 2003. I switched to OPT in August 2005 and to H1 in May 2006. I've not been out of the country during this time, except for a month in 2005

Yes, then if you are not married, you have a classic dual status filing situation. You are essentially dividing your year into a part non-resident and part resident.

If you are married you can elect to be a resident for the full year with your spouse. Otherwise do the dual status.

Agreed; unless you are married, dual-status return is required.
