Who has the rights to the deceased ashes? The deceased mother, his first born son, or his other children

Mother is getting her son cremated, with the deceased oldest son's blessings, but his other children are refusing to let her have his ashes. Who has the right to the ashes.

Who paid for the cremation ? That is the first thing we need to know.

Who ever is the heir of the estate, unless something, was mentioned in the will.

The "eldest" son, may or may not even have the right, to decide this ( depends on where it is, here in China, yes eldest son would be the one, to decide.

In America, merely being eldest son, is no more important than being the youngest son.

If the mother has already made arrangements to have the body cremated, how do the other children have a say in the matter? How can they not let her have the ashes; they don't have the ashes? The crematorium, I would think, will answer to no one but the mother (who presumably paid them).
