We just purchased a new rv in August, 2015. We visited the rv dealership and walked though the rv. We asked (more than once) if this rv was a new 2015. The owner (who was also the salesman) assured us we were purchasing a new 2015 rv. He even printed out a estimate of all our cost for this rv. He indicated on the estimate sheet it was for a 2015 rv. We agreed to the price (we were assuming it was for a 2015 rv. However, when we received the title from the state it showed a 2014 year. The dealership also sent us a Receipt for RD-108 Dealer Transaction, which showed the rv was a 2014. We feel we have been duped, as we would have not agreed to this price for a 2014 model. We also saw a sticker on our new rv that showed it was manufactured in 2014, which we only found after we had to get serial numbers and information to fill out warranty paperwork. The dealership totally misled us into believing we were purchasing a 2015 rv. Do we have a case for legal action against this dealership?

Sorry for mistake. I meant to indicate we purchased this rv August, 2014, instead of 2015. But the rv we thought we were purchasing was for a 2015 year make.

On the face of it, it sounds like you could win a case. With cars, the 14s are still new on many lots and are being sold at discounts while the 15s are sitting right next to them. A car dealer wouldn't dare call a 14 a 15.
However, I don't know enough about RV manufacture to know if one year can be the same the next. The chassis can be one year, the engine another, the interior another, I'm guessing. It's possible that there is nothing legally wrong with what he did. I would contact the manufacturer with the exact brand and model and ask. I would also tell the dealer that you plan legal action. If he duped you, he will scramble to give you a refund of several thousand dollars, which you should research before you even talk to him. It doesn't sound right that you saw if BEFORE the sticker was put in the window?

August 2014 would for most manufactuares actually be a 2015 model. They almost all switch over production lines June and July.

Although I agree with you, smoothy, about the August cut off date for most manufacturers making them be 2015 models, in cases like that, the title and paperwork will show it as a 2015. It does sound like there was something a little shady going on here with this one.

I'm curious as to how important this is. The first question I would ask is what changes, if any, are being made to the 2015 model. These changes may be insignificant. I would be more concerned if you were sold a pre-owned model rather than new.

So before you go off suing I would check a) what enhancements were made in the 2015 model, and b) what would be the cost of a 2015 model. Its possible, the price you paid was predicated on it being a left over 2014.

And this goes to the possibility of your winning a suit. To win a suit, you have to show damages. If you over paid for a 2014, then you have damages because you were misled into overpaying. If you got a bargain on a 2014 you may not have any damages. If you were looking for specific features only available in 2015 models, then you may also have a case. In that case, the more likely result is the dealer taking back the one they sold you and substituting a 2015 but you may have to pay more.

It does sound like the seller hid the fact that it is a 14 in order to get a better price.
That's why it matters - 14s are marked way down, and it matters for resale value too.

When you signed the application for Title, the year had to be on the paper work.

Chuck is correct as is joypulv, the only thing that counts is the documents. If the bill of sale shows 2015 and the title is 2014 then you have a case. Reread everything you got during the purchase.
