Ask Me Help Desk - She CAN'T kick me out?

I just came across this site while scouring the internet for any shred of legal support!
First, I am from Ohio. My two boys and I moved in with my fiancé in July 2006. "Suzy" and I are separating. The situation is deteriorating quickly here primarily because of her testosterone pumped and VIOLENT eighteen year old! I am in the process of finding a new place for the boys and myself. From what I've read here, having a utility bill with MY name on it for this residence (which I do) is going to be enough to prevent her from forcing us out. Am I going to be able to successfully use this to prevent her from kicking us out BEFORE I have a new place to live?

Even IF a judge believes you're a tenant, you can still be legally evicted within, say a month.

And it actually can not stop her from kicking you out illegally, she can put all of your stuff on the porch and change the locks, All this gives you is the legal right to sue her in court ( and win most likely)

Remember mean and violent people do not always follow the law and follow legal solutions. They merely react. There are many cases where people are illegally thrown out, landlords illegally cut off electric power and more. Being right and having a law to protect you does not stop them from doing it, if they don't mind breaking the law.

It merely gives you a right to sue them for damages latter.

And if there is a violent person and your children are in any danger, would you want to stay for long ?

gdajj: Get to movin'. Get those children out of there! Legally, she need to give you a 30-day notice to move. Is there someone else you can stay with until you find a new place? If you are paying rent and bills, I would withhold that and take it to get another place. Let her sue you later for non-payment, but get the kids out of the situation.

On a lighter note, maybe you should introduce her to ex-con!

I believe if you are not listed on the lease all she has to do is call the police to have you removed. I wouldn't be waisting time finding a new place. Having your kids around her son sounds like a bad idea. As stated by Fr_Chuck, people are capable of incredible acts of cruelty especially ones that have once been close. The curse of being human I suppose. Don't underestimate her capabilities. I have been with women for over 10 yr now... as lesbian... and they are capable of being extremely deceitful, hurtful, scary, and downright evil. A man may kick your... but a woman will get you back! Yes please understand what a person can do legally has nothing to do with real life and what many people do in real life. So what if you have the right to stay there for 30 days ( and that is all you would have at most)
So at most legally she can evict you with 30 days notice. And legally if they throw you out before the night is over, you may sue them, but that does not mean you can stay in that house, it merely means you can sue them for kicking you out.

But as a police officer what was legal and what was actuallly done by mean dangerous people is two different things, I have seen them pile anothers clothes in the back yard and burn them,
I have seen then take a baseball bat and break everything in the house they could. I have seen then take off with the kids of another person and since they were living together the DA did not go kidnaping but just interfering with custody. And honesty ( sorry ladies) when it comes to being hateful women are the worst, but the men ( and you have a 18 year old man to deal with also) can beocme physcially violent also.
And a chair thrown can accidentally hit one of your children very easy.
And I don't want to count the times I helped drive someone to the ER or called a paramedics for someone that had a problem.
( and hopefully once you leave you will stay gone, because sadly I will also get called back and back and back to the same house week after week for a person who was hurt or throw out, and they make up two days latter, and the stitches are not even healed yet.

There are normally family shelters or something if you have to, I would get out if the situation is as dangous as you make it sound.
