    Hi

    Could anybody help on below situation

    I satyed in US from 2010 Dec to 2013 December and payoll last generated date is on Jan 5 2014. I moved to my home country.

    I again Coming Back on Sep 15th 2014. Will it consider in less than 180 days? For 2014-15 .Please clarify

    You have met the 3-year Substantial Presence Test, so for 2014, you will have to file as a resident alien for 2014 under the "continuous presence" policy.

    This means you must declare ALL world-wide income (to include your Indian salary and interest earned in Indian banks) and file Form 1116 to claim the Foreign Tax Credit for Indian taxes paid.
