In Texas by law how long can a guest stay at my apartment before they are considered a resident because my nephew who is on my lease has a girlfriend who comes over all the time and her dad that she lives with could care less about his15 year old daughter. My apartment manager keeps saying she is going to kick us out if they found out she's staying there but I can't just tell her to sit outside all night and wait for her dad to answer she's 15!! He ignores the door when she leaves my house at night so I feel like I have no choice but to let her stay the night. My apartment manager is so in my business and I don't even come out of my apt. I need to talk to someone about my apartment manager cause I asked her what am I supposed to do I can't just leave her outside all night. And the manager suggested that she give me a key to make a copy of the dad's apartment but I don't want anything to do with that key cause that's not my apartment or daughter and I have no right to someone else's key. There is so much going on here and I don't know what to do in this situation. I feel sorry for the girl but I can't afford to pay for another person especially if it's not even my child. In a situation like this what should I do

It's not a matter of Texas law; what matters is the terms of your lease. If your manager has problems with her staying with you, it may be that the lease prohibits a "guest" staying more than so many days per month. Check the terms of your lease.

Well the thing is, I try to send her home. Her dad won't answer the door for her to go home and conversation with her father won't get anywhere. He don't care about her. So I feel bad. I cant leave her outside all night. But I also don't want to get kicked out of my apartment because her dad won't let her go home.

Do you actually see this or is that what she is telling you? I find it unusual a 15 year old does not have a key to their own house.

How about calling CPS on them and let them investigate.

Smoothy asks a good question. Have you actually talked to the father? I'm assuming here that the girl lives in the same apartment complex, at least that's what you make it sound like. Have you walked her back to her apartment and knocked on the door? You could get in serious trouble by coming between the girl and her father.

But if he is truly, locking her out, then you should call CPS the next time that happens.

The father must allow his minor child in, by law. Tell him that, without emotion.
Have her with you when you knock firmly on his door at 8 pm, and tell him that she will be out your door each time at 8 pm from now on. Try this before CPS. You have to share the building!

And don't apologize, explain, or even mention the manager. It's irrelevant.

There is also the possibility that she is telling OP, inaccurately, that her father won't let her in, because she wants to spend more time with the nephew.

Yes we live in the same apartment complex it's small and everyone is in everyone's business. The apt manager used to sleep with little girls daddy so she has some kind of hate for him and anything having to do with him. That's where this whole wanting to kick me out stuff started coming from. Cause it's his daughter. The dad is a total , the other daughter is in juvinile detention. She's only 14 and used to work in a strip club with a fake id. What kind of father lets that happen? This is the kind of guy I'm dealing with. He met a new woman who has a little girl. The woman and little have been staying the night there and the days she stays the night with her daughter, those are the nights he don't answer. I actually never thought about CPS. So thank you someone for bringing that to my attention. I don't know why that never crossed my mind.. Duh! Thank you everyone for the advice. Y'all have no idea how much I greatly appreciate it.

Best thing about calling CPS... you can pretend you didn't know anything about it, because they only act if they investigate and find cause. Save yourself a lot of grief that might come raining down otherwise.

No the 14 year old wasn't caught she quit before she got caught. Cps is already aware of the dad. Neither if these girls go to school. It's a sad sad story. These girls have no guidance. No motherly figure to learn from. And what I don't understand is that the mother lives not too far. And it pisses me off cause the lady seems like she takes good care of herself. She's a nice looking woman. From my understanding the mother made them live with the father because now she has a 3 year old boy and before the little girl got with my nephew, the 14 and 15 year old were getting out of hand selling drugs out of her house so she did what she had to do to keep the little one from seeing the way these two are. Which is understandable, but if you know the girls are still doing bad I'm sorry but I believe in a good old fashioned whoopin. My daughter is 13 A & B honor roll recently started jr high. In 5th grade my daughter started tutoring math to high school kids. And I'm only saying this cause being a mother... I put my hand or that belt to that when needed. My daughter tried to come at me with she was going to call the cops on me. Thank God I already had a conference with the teacher when she was little cause the techers husband was a cop amd he himself told me in front of my daughter that I am allowed to spank as long as its on the bottom and not out of control. So when my daughter heard that it scared her and she stopped her crap at an early age. Why can't these parents do the same. It breaks my heart knowing that they don't have anyone to show them how to be a lady. The dad just don't care what they do. I mean come on these two girls have been admitted in the hospital cause they thought they overdosed. I mean this really does break my heart and sometimes I want to know what its going to take for him to just let her go and come with me. She lives in a toxic environment at home. The apt manager needs to get over the daddy so we could all just live in peace. The sad part is the owner of the apartments lives a few doors down and even he don't get in our business. He always tells us we are great tenants and we never bother anyone but the owners are from china and cant get a complete understanding of what's going on. And the manager walks all over them. She even steals rent money and starts drama in the apartment complex and they still won't fire her she's so unprofessional that I've started using voice recorder every time I go into the office to make sure I have everything she's saying just in case this gets too fast and I have to go to court for it.

I'm starting to hope you keep letting the girl stay with you, and be a role model for her before she ends up selling herself on the streets at 16.
The manager can't prove that she is in your apartment and not his as far as 'residing' there goes! And of course what difference does it make anyway, if both apartments are in the same building? Same occupancy either way.

Well the owners live a few doors down. This place used to be a extended stay motel that they remodeled to 1 and 1 ½ bd rm so the complex is shaped like a rectangle and the doors are a long the in side. There are two 3 men drom china who own them and they do everything here maintenance, plumbing, electrical. They also do the yard work and that's everyday all day so they can be noisey. So actually they do know everything. But I actually woke up really pissed one morning and yelled at the top of my lungs about her going home and so far it has worked.
