can the father of my son put a judgement or collect money from mt=y social security because he thinks he paid too much child support when in fact he did not because my son is 2o years old a full time college student and lives at home with me the mother and the father is in arrears. The child support order was field in New York state and the father lives in New Jersey and some how the order was transferred to New Jersey. We were just in court August 12th because the father wanted to emancipate our c our son and I agreed because I am tired of going to court every month.He was granted the emancipation and ordered to pay the arrears but did not pay it yet. I sent a copy of my sons schedule to the judge and I do not know what to do because I was told it I do not go to New Jersey he will win. We have been in court 16 teen times and I have always asked for a telephonic hearing and has been approved but this time they said I have to travel to New Jersey and I can not afford it and I have medical problems

It's all too vague as far as arrears, sorry. You don't say when the transfer to NJ happened. If you don't have a clear record of what he owed and what he paid, then it is possible that he can get a judgment (I'm guessing for amounts since he got it transferred). But the court ordered HIM to pay you arrears just 12 days ago, so I'm wondering if he is just blowing hot air and is furious that he is still supporting his son through college, and you have nothing to worry about.

If you have no money for a lawyer, try a social services worker or community center in your area.

Sounds to me like your ex has an attorney who is playing the system. Since the original order was in NY, as long as you still live in NY, then it should not have been transferred to NJ. You should fight that.

HE cannot "put a judgment". A court has to issue a judgment, and also issue an order to collect on it.
