    In the state of California, if a parent has a felony, are their parental rights easily terminated?

    No, you will still have to show and support the claims, were they there with the children before convicted, do they write the children and so on.

    With family court nothing is easy and nothing is always the same, can vary from judge to judge. You will just have to file and try.

    In California, having a felony on your record is not a reason to terminate parental rights. Termination of parental rights is a legal process. Takes time.

    Termination of parental rights is a serious business. Its not done lightly and involves a court process. Generally, its not done, unless there is a someone waiting to adopt the child (like a step parent).

    A criminal record would be taken into account, but that's more likely to eliminate visitation rights, not full parental rights.

    In our case, my brothers ex married and is now trying to get her new husband to adopt my niece and they are trying to terminate his parental rights. He is encarcerated, he DID respond quickly to the courts and some are saying its an uphill battle. It is crushing to our family... Thank you so much to all that have responded. It is the first time he had ever been in trouble.. of course as his sister I'm doing all that I can to help him..
