    Resident or Non-resident
I came to us on May 22 2006, do I qualify to be a resident alien for tax purposes?

    Thanks

You are a dual-status alien and must file a dual-status return UNLESS you are married.

If you are married, you can file jointly with your spouse and you BOTH choose to be treated as resident aliens for all of 2006. However, in doing so, you muts claim ALL of your 2006 income, be it from the U.S. or your home country.
