    My roommate doesn't want to pay or leave
    Hi, my situation is started to share my apartment with a guy a month ago, we have written contract with each other but his name its not on the lease. After argument we had recentely he refused to pay the rent and he doesn't want to leave also. I give him 3 days notice of pay or quit and also 30 days evication notice .but he left them behind door which looks like he never received them . You thing should I talk to landloard or I need to open a lawsuit against him. I'm living in California and I'm a student, so rent is too much for me now.
    PLEASE help me to deal with this problem:o

    I don't know about California, but in Virginia if they are not on the lease and you ask them to leave and they refuse then they are trespassing and you can ask the police to have him removed.

    Also here, you would able to file a civil suit for the part of the contract that he didn't fulfill.

    Since he's not on the lease and has a contract with you then YOU are his landlord and your landlord has nothing to do with this. What does the contract you have with him say? Since he did pay rent at one point, then he is a tenant (YOUR tenant) so he's not a trespasser.

    So you have to go through the legal process of eviciton for your area.
