    1040NR-EZ for Dual-State employee
    Hi all,
    I have been reading this forum and have got most of my questions answered. However I still do need to iron out few doubts

    I am an Indian Citizen. For 2006, I was on F1 till May 15, OPT till Oct 23 and H-1B till Dec 31. I am filing 1040NR-EZ since I don't clear the SPT. However, I have been working in 2 states - VA (base office) and NY (client side). I have received 2 W-2s from my employer and I already have one W-2 from my university. The "Wages, tips, other compensation" (Box 1) on both job-related W-2s (VA and NY) have the same amount. I contacted the payroll department and they said that NY-W2 will report the full federal wages even if I worked in NY for a day. They have asked me to file IT-203-B with my NY tax return to apportion the wages based on the ratio of the days worked in NY.

    My question is for 1040NR-EZ for Line 3, should I combine all 3 W-2s (VA + NY + University) or 2 W-2s (VA + University) ?

    I'm tending to lean towards the second option (VA + Univ) since I'll be double counting my taxable income if I add the wages from NY W-2.

    Please advice

    Combined just TWO W-2s for the federal return (VA + University).
