    Evict a Family Member from My Home
    My brother is a meth addict who sleeps on my mom's couch. He refuses to get help or get a job. He doesn't pay rent. My mom's house now has holes and writings on the wall from when he is on one. He has even physically attacked my stepdad and is now stealing things to keep his habit. How do we evict him? Do we have to go through all the court dealings? He's not on the mortgage, no bills come in his name. He doesn't even get mail. I've read quite a few articles and some go against what another said... HELP! I'm in CA if that's relevant

    He physically attacked your stepdad and he's not in jail right now why? Were the police even called.

    THe next time he starts damaging property or threatening anyone... or brings drugs into the house... call the police.

    Otherwise you have to give him the required notice for your state... if you are inFlorida you have it easy, its 15 days... 30 days in most of the country except California.. when it might be as much as 60 depending on a few things.

    THEN you would have to go to court to have it enforced.

    If you find any of the ingredients used on cooking meth in the house call the police immediately... they are exceptionally hazardous when mixed together.

    Bottom line is on most cases he would be considered a resident and would have to be removed legally which means formal notice to vacate followed by going to court for an eviction order.

    On the other hand, if he is dangerous and violent, you call the police and get a restraining order against him.
