Is the legal action still the same if the fathers name is on the birth certificate but father has been and still jail. I hyphenated last name carlton(mine)-moceri(his). He really wants nothing to do with my son.

A birth certificate is a legal document. It generally requires a court order to change it. Such a court order will generally require the approval of birth parents.
