Did your mom have a will or made arrangements for how this should be handled? Generally couples discuss their wishes between them and if there is nothing in writing the spouse handles all the arrangements. I have never heard of any automatic rights to remains.
Sorry for your loss, but unless you have something in writing from your mom, you may be stuck.
Was there a will ( as asked) was there an estate? Normally a persons husband or wife would be the one to have the ashes.
