In general, no.
But it would depend upon which state or country in which this person is located.
What exactly is "jovnile reked as adlat".
They got a 4th degree sex offense as a juvenile when they were 14. The reason being having sex as a juvenile. That same person got into trouble as an adult for an unrelated offense. The person is on probation. The probation officer is now using their juvenile sex offense case to place that person on sex offender rules. The person was told that they do not have to register as a sex offender, and the adult crime that was committed was not a sexual offense.
Was there a probation period for the first offence? If so... has it run its course before the adult charge?
If they were still under probation for the first charge... then yes it could be brought back up as a violation.
If the first charge and its probation period expired before the adult charge... then no it shouldn't. Domestic violence is not a sex crime.
Probation was given for the first offense and completed. The person was not on probation when the second offense occurred.
In that case everything is based on the last charge... which is domestic violence... which isn't a sex crime. Therefore shouldn't be required to sign up on the sex offenders registry.
Does that also mean that the person's probation officer shouldn't have them on sex offender rules? The person isn't registered and doesn't have to be registered. As of now, the person is not allowed near many public places due to the rules that the probation officer has placed them on. The person also has to participate in a group for sex offenders.
It might be wise for that person to talk with their lawyer and let the lawyer resolve this issue.
