It is very hard to "take" away his rights if he does not wish to give them up, But you will need to hire an attorney and prove he has abandoned the child.

It is his child, so you should just let it go. No judge is going to let this happen unless he is proved grossly unfit.

Im in the same position only Im the step mom and it's the mom who won't give up parental rights. Its next to impossible everyone has told me. Even though the birth mom has nothing to do with our son and only comes by once a year for our daughters birthday and is gone without any contact the rest of the year. She's also in the system for possession of meth. She's not even allowed to see them without supervision and is very drugged all the time; and she's moving out of the state soon. If you find a way please let me know.

There is nothing wrong with being a step parent. A piece of paper is not going to change anything.

Your right except that my son wants to know that he can't be taken from me no matter what happens.
