You must get a lawyer, it's not going to look good that he didn't get to court. And the longer it has been the harder it is going to be. Basically most states are taking the position of kids rights, and usually after about a year the kids will be adoptable and parental rights will be terminated. You have allot of research to do, find out all about what will make your home attractive as a stable place for them. But You will have to get a lawyer.

Yes you have not said how long this has been, the kids could be adopted by now if you have waited too long.

But as noted you will have to hire an attorney to petition for the return of his rights.
