    Another f1-opt-h1b case
    Hi TaxExpert,

I'd appreciate any tips I can get!

    Facts:

Entered US: Aug 2001 on F1
    Graduated: Dec 2005
(small lull between graduating and OPT start-date)
OPT: Late Jan 2006 - Late Nov 2006
    H1B: Late Nov 2006 - 31 Dec 2006

    Questions:

    1) Resident or non for tax purposes? 1040-EZ or 1040NR-EZ?
    2) What kind of deduction am I entitled to? (no special country agreements)
    3) Does that status apply similarly to state/city tax filings?

The more I read up on it, the more confused I am.

    Thanks in advance!

If you are single, you are a non-resident alien (Form 1040NR-EZ).

Unless you are from India, you can only claim itemized deductions for state and local taxes withheld, charity donations and employee business expenses.

    3) No, the states and cities treat you like a U.S. citizen.
