There is a huge tree that straddles the property line. When we bought our home 42 years ago, it clearly belonged to our neighbor. Over the years, it has grown over the property line. Our new neighbor would like it removed and wants us to split the cost with him. We are on a fixed income and cannot afford this. We have told him he can remove it, but in doing so he must be careful not to destroy our fence.

What are our rights? Can he force us to pay for removal of the tree?

No. In fact, since it straddles the line, you have to give him permission to remove it. Tell him, you don't mind if he has it removed but you are in no financial position to help pay for it.

If they want it down, they can pay for it. You are under no obligation to help pay except as a good neighbor.

Why is this labeled "Property line disputes"? As I understand the question, there is no issue as to the exact location of the property line; only as to responsibility for paying for removal of the neighbors' tree (which responsibility, as others have noted, clearly rests with the neighbors).
