Ask Me Help Desk - Teen rights and JDC

My 15 year old daughter who was on probation ran away. When she was found she was immediately taken to JDC. We fought with her PO and got her released to our custody to take her to get a phych eval at a local ER. The eval sent her to a inpatient treatment facility where she was diagnosed as being bi-polar. She has spent the last 6 days there getting treatment. She was put on medication and given lots of therapy. She is to be released today and we were informed we have to pick her up and take her to JDC immediately to serve 17 days for her probation violation. This is not where she needs to be, she now has a mental disability and hasn't even been on the meds a week. Is there anything I can do to put her in some kind of mental facility or therapy place to serve her 17 days instead of the JDC? We are in Ohio.

Children do not have the same rights as adults, and even an adult, has to serve jail time if it is ordered. They can get her meds served there.

You can hire an attorney and file for another sentence or to have that sentence delayed. But it will be up to the judge.

Obviously they believe that home life was not providing enough for them to want detention time.

Also, and I am sorry, they did a crime and ran away while at home. What are you going to do, what extra security have you added to prevent her from just running away again ?

We have moved her bedroom next to ours and since we have never had this problem before, we have never worried about. My problem is that now that we know what caused the impulsive behavior, we can better understand what is going on. She was put on probation after we filed unruly charges recommended by the school for her sneaking a boy into our home late at night, the same boy she ran away with that is at the same facility. Part of the reason I don't want her back there is because she has now been away from him and with the theropy and meds she seems to be acting more like her old self. I'm worried that if she sees him again so soon it could harm her progress that she has already made. This JDC is very small and they would be in the same classroom for schooling everyday.

You have to get a judge to order a different way to serve the remainder of her violation.
