I am an international student in Georgia since Aug. 2004. I had two internships in Washington DC from June to Dec in 2006. Now, I have my W-2 with me. School told me that I need to file a Georgia return if I have income in 2006. My questions is, my income wasn't from Georgia but Washington DC, do I need to file a Washington DC income tax return as well? I am so confused now... anyone please help me.. Thanks!!

You DEFINITELY need to file a DC tax return if that is where you got the income. Whether it is taxable or not is another issue.

If there is no income earned in GA, you need NOT file a GA tax return, since your status as a student makes you a non-resident of GA.

Thanks for your reply, but I have GA State tax withhold on my W-2, if I file the DC return only, Do I still get my GA state tax back? Or I should just use that as other states tax credit on my DC return? I assume that I don't need to pay states tax under F1 visa as a nonresident, right? I've called to DC Revenue to figure out the issue, and they seem not quite well to answer my questions. They told me if you are in DC more than 183 days, you need to file a DC return as a resident of DC. But I remember that we F-1 visa holder are not subject to that calculation and are consider as nonresident.

You did not say that you had GA income tax withheld. In that case, dile the GA return to get the withheld income taxes back.

Students are normally considered non-resident wherever they are (unless they are located in their home state; not in your case).

However, if you EARNED the income in DC, you must pay DC taxes, even as a non-resident.
