Me(H1B) and My(H4) wife come USA on 7th Oct 2013 and continue living here till date. Can I file tax as resident alien?

Yes, you CAN file jointly as residents, IF:

- you sign a statement that you CHOOSE to be treated as resident aliens for all of 2013.
- You wait until 4 June 2014 to file
- you get an ITIN for your wife
- you declare ALL world-wide income earned in 2013.
