    HIPPA violation?
    Scenario: inpatient drug rehab... patient is doing a short skit for the other patients and asks a staff member to record it. Staff member uploads video to YouTube for said person to view. There are no names or location given. There is no way of identifying what kind of facility it is or that its even a treatment facility as opposed to any other venue.

    Is this a HIPPA violation?

    If the person does not have prior permission of every person in video to post it, then yes it would be violation.

    It is best to have permission in writing.

    I don't think that is a HIPAA violation. It has nothing to do with divulging medical information and from description, appears to be pretty generic.

    HIPAA functions differently with drug/alcohol rehabs as well as mental health.

    Yes, this would be a HIPAA violation without a written waiver from every person in the video.

    By the way its HIPAA not HIPPA.

    But the key point here is "every person in the video." As long as the facility is unidentified and no medical info is revealed, then you would only need to get a waiver from everyone shown in the video.
