W7 filing with expired h4 visa but extension is on progress with uscis receipt number

Hi,
I just want to ask something about w7 filing. My husband having h4 visa under my h1b visa will file a w7 to be included him in my tax refund. But my problem is his h4 visa was expired last November 2013 and we filed the extension last oct 2013 and until now the visa is on process. Is the uscis receipt will be accepted by the IRS? Please help. Anybody gone this scenario?
