    My ex husband passed away. Can my new husband adopt my children?
    I was married to my ex husband he sadly passed away. I remarried and my children call him dad. Can my new husband adopt? My 3 children adore him and has asked for this. My eldest is eight , then my six year old, then my 4 year old. They all want the same name as me, and my husband.

    It is wonderful that you found a man, who is willing.

    Adoption is by state law (if in the US) but I see no reason he can not adopt.

    Since the natural father is deceased, all you will need to do is present a copy of his death certificate along with the petition for adoption. This is the first time I've ever thought that this could be done without an attorney, but since everyone is in agreement, you may be able to get away with it.
