    Does both parties have to agree in order to evict?
    My girl friend and I own a home together (both names on deed of trust) in Virginia. I have a problem with her 20 year old son and want him evicted from the house, he has no lease agreement or contract. She refuses to make him leave, what recourse do I have. Does both parties have to agree in order to evict.

    A deed of trust is similar to a mortgage; it constitutes a lien upon your property. I assume that the two of you also hold title to the property (i.e.: you and your girlfriend are named as grantees in a deed). If so, yes, the two owners would have to agree in order to evict him.
