A friend has a wife that has kept him from seeing their children for over a year. It is killing him! He can't afford an attorney On Dec. 23 2012 when a restraining for the kids was over (He went with a peace officer for protection from her consistent restraining order allegations) She said the kids were not there and the following day she once again filed a restraining order. Just to keep me from seeing his kids. This is effecting the children as well, I am sure. She has had him arrested three times Just by saying, "He violated the restraining order in one way or another! On top of it her accusations are only to keep him away and not even true!

Now he is facing a much larger criminal act (stalking) for reportedly violated restraining orders, Nothing has been proven. He still has not gotten to see his kids nor have they gotten to see him for over a year. Still he is unable to see the children. What can he do about a lying woman scorned that just keeps preventing the kids as well as him from being a part of each others lives again? When ever he does get his day in court for some reason her allegations are considered against him and they just do what they do and will not listen to his side of anything!

First, is there court ordered visitation? Second, what grounds is she using to get the restraining order? Has he shown up in court to contest those grounds? Has he even asked for a hearing on the restraining orders?

Also he needs to file for custody. It doesnt matter if a restraining order is in place. The courts can find a mutual drop off point for visitation.

He needs a lawyer, or a long talk with a fathers rights advocate. Going it alone on his own is his downfall.

Thank you Tho he has had two different attorneys which failed to do more then accompany hin to court. He is short on money and deep in sadness. He feels powerless and alone. I thank you for him and will relay the message :-) LaRae

Part of his feeling of powerlessness may be due to his not exercising his rights properly. Sounds like he has been getting bad advice and making bad decisions. He needs to take more control of the situation, Let him create an account here and ask for help directly. This way he can more accurately give us the situation and answer questions and we can help empower him with knowledge.
