    H1B spouse educational expenses
    I am currently on H1B status and my wife has been here with me for two years on a H4 status attending college full time. From what I understand, I am supposed to file an ITIN for my spouse along with the federal tax return. How do I go about claiming for her educational expenses? Can I even claim the educational expenses?
    I asked the university to send us a form 1098-T but they denied saying she does not have a SSN or ITIN. What do I need to do?

    You can claim the Education deduction as an adjustment to income or one of the Education Credits using Form 8863.

    If the university will not issue the Form 1098-T, you MAY have to get the ITIN first, then amend the return to claim the deduction/credit.
