If he did the hitting the chances are he is at fault. You did not mention calling the police. They would have issued him a ticket. They might still be able to file a report that could come in handy with your insurance company. They would go after the other guy for payment.

If you were at an intersection and had a gree light, and you were going straight, you have the right of way, a car coming from the opposite direction would have a green light to go straight most likely, and the car turning left would have a yield.

So the accident the way you described it would be the other persons fault,
But this is where you call the police and let them do the report. And in the end let the insurance companies decide who pays what.

The police were there and the other driverf was citicated with a ticket, but know my cousins insurance company is trying to give us a hard time about paying for the car because I'm nnot on her poilcy, but I don't have to be she has full coverage and I don't live with her. So why is her own insurance company trying to frog us. The other car hit me so he is responablie.

The police were on the scence I couldn't even move out of the car the drivers door was damage so bad. MY cousins insurance company is trying to give her a hard time because they want to know why aren't I listed on her policy, well I don't live with her and I don't use her care all the time so why should I be listed plus we are not at fault for the accident, so why is her insurance company trying to work against us ? The other car should pay for damages right?

If you filed a claim with your cousins insurance you have created the issue. If the other person received the ticket you would have been much better off filed a claim with them. Don't sit back on this, track down the other guys insurance and call them.

The other person should be paying. Not your cousins company. As long as it states that the other driver was at fault then your cousin should not even worry about it.

Good luck, I hope everything works out!

"...as it states that the other driver was at fault then your cousin should not even worry about it." Not the case if this other person is an uninsured motorist. This is illegal in many states but doesn't change the fact that there are drivers out there without insurance. Your cousin, an his insurance company, would be holding the bag if this guy doesn't have coverage. Sure you can sue him if he has no coverage, you may see your money in 2 - 3 years.
