    Tenants Harrassing/Threatening Landlord
    (State of GA) I filed a Pay or Quit Notice against Tenants occupying
    My because they failed to pay late fees. Their lawyer told me I was not
    In my rights since I am not recognizing there's a lease. For the
    Last two months, these folks have refused to signed the lease
    And return original, signed copy to me. Instead they are using
    Their own copy without providing to me original signatures.
    I informed them they are Tenants at Will. Since the Pay and Quit,
    They have since failed to pay December's rent per the terms given
    To their lawyer. Tenants did not follow those terms,
    Refusing to pay by western union as required, thus they did not pay.
    They told me I can pick it up! I then filed eviction against
    Them. They have verbally cursed me out, threatened my safety
    By taunting me to come over if I want to and see what happens, etc.
    Told me I had better not show up to collect, inspect or do anything or
    Else, and so forth. Just unacceptable behavior unexpected of adults.
    They verbally threatened my handy man. As a result he refuses to return
    To complete any repairs until they have vacated, which I concur.
    What other legal recourse do I have in addition to filing the eviction papers?
    They are to answer on Dec 26. I want them to pay into the Court what they
    Owe but to also use their verbal threats and fact that these people pose a risk to me by further dealing with them as mitigating factors to further show judge they need to be evicted in addition to not paying rent. Thanks.

    1. if they really have an attorney, hire your own. It will be worth it.
    2. lesson learned, they do not walk in the door, no key until you have signed lease from now on.

    So what ? If they have a lease, they have to pay. That is just smoke to confuse issue.

    The only issue, they have not paid.

    Why have you not filed for formal eviction in court.

    Do not talk to their attorney again, you will say something stupid being recorded by them.

    I will add that I am not sure you can require them to pay by western Union, since there are additional costs to that. And of course many fraud is done by western union payment.

    To be honest if my landlord told me to pay by western union I would refuse to pay that way also.

    I'm a little confused here. When did these tenants move in? A formal lease is not required as long as you can prove that they are occupying your property and agreed to pay rent. Without a lease it makes them tenants at will.

    I also agree with Chuck, that you cannot require payment by money order. And if they have the money and pay at or prior to the hearing the Pay or Quit notice can no longer be used to evict them since they fulfilled the pay requirement.
