    Emergency Hearing to see mother who is failure to thrive
    My mother lives in a dementia facility in Aurora, Co and my brother has POA and will not allow me to visit my mother who is dying. The facility does not allow me to visit my mother. How can I request a hearing or what can I do so that I can see my mother. I have written my brother begging to see my mother. No response.

    First, what is the reason you are not allowed to visit? I'm not saying you are a bad person but in order to give an accurate answer we really need to know if there is something behind the reason you are denied visitation with your mother.

    I would contact an attorney in Aurora about getting, as the title of your thread suggests, an emergency order from the court. You could contact the clerk of court there to see if there is a form you could fill out, but I doubt there will be one I'm afraid; It doesn't happen that often.

    With all due respect, I don't think we need to know this. There are two sides to every story, and the person holding the POA may have his side, but I am sure a judge will have to decide in any case.

    I wasn't saying we needed the exact reason because I'm being nosy. Maybe I should have worded it better. Having worked in a nursing home I have had to deny people access to residents (including a spouse) with just cause. It isn't something fun to do but because of this I was trying to make sure it wasn't something that had already been established.

    The easiest way to solve this problem would be to settle the dispute with the brother no matter how unlikely that would be.
    Knowing whether it is something trivial that caused the rift (as it many times is) or something serious would possibly produce a suggestion here that would treat the disease (the cause of the rift) rather than the symptom (no visitation).
    By the same token, there could be a serious and legitimate reason that the brother has taken this stand and I don't want to suggest what those reasons could be, as it would come out accusatory toward crs10mil. We don't know.
