We are owed money ($5k) by a couple that live in WI. They are getting divorced and selling their house. Can I put a lien on their house so we get our money or do I have to take them to court?

First its not a good idea to piggyback your question on another thread. To avoid confusion I've moved your post to its own thread.
You can't place a lien on property without a judgment against the debtors. The exception to that is a mechanic's lien when you have worked on the property. So a plumber might place a mechanic's lien on property they worked on but weren't paid for.
Otherwise you first have to sue them, win a judgment then have a court issue a writ to place the lien.
