    How do I garnish?
    Have just received judgment for $1500 against ex-friend for failure to pay loan )which I now have to make monthly payments on anyhow. Person has $1600 pension (which I cannot garnish) but has recently received large settlement and is employed part time. Does not have bank account - can I and if so, how can I garnish salary?

    Hello pilot:

    You need a "writ of execution", or whatever they call it in your jurisdiction served upon the empoyer. I would get the court bailiff, or constable, or sheriff to do it. They know how.

    Go the court that granted the judgment, ask them for the form for garnishing account or wages, they will have them.

    Once you fill out the paper, you can mail it certified mail to the bank or employer and they will do the rest. The next way is to serve him with a summons to appear before the court for a oral examination of all assets. Look that up in your states court procedure.

    I am going through the same issue here in the State of Washington. After you get a judgement in your favor. The other party has 30 days to appeal. If they don't appeal, then you pay a fee to have the judgement entered into the courts docket. Then you fill out an "application for writ" and a "Writ of garnishment". Have 2 extra copies because one of them the court keeps and files and the other you send to the other parties employer or bank. Then the employer or bank is to send you "The answer". I'm not sure what happens after that. I'm about to mail my certified "Writ of Garnishment" today.
