My x lives in a different state(Ohio) I'm in Pittsburgh. Can he take me to court because I'm refusing to take him to tutoring classes at a place called Mathnasium because the school has resources o help him in this area without us spending the extra money. This place said he's at a second grade level in mathe(he's in 5th grade) mean while his test scores in school beg to differ. His teachers said no way. However, he's supposedly taking me to court over this. Can he? I'm not unfit or on drugs, this is crazy!!

Yes he can take you to court over it. Also if it benefits your child why don't you want to do it?

Because he's actually doing fine in school and just needs extra help which the school already has in place. He lives in Ohio and would not be taking him. We would have to take him and we have other children and a packed schedule. If the school has help in place why go out side the school unless absolutely necessary?

As cdad said, he certainly can take you to court over it. But it would be on his part to prove that its necessary. If his teachers are saying its not, they can be deposed to testify that its not necessary and the Mathnasium school would have to testify as to their findings. If its very subjective, they may not agree to it.

The thing is where was the original custody order issued? If it was in OH and your ex is still there, then they may have jurisdiction so you would have to fight this in an OH court.

The custody order is here. He is supposed to have him every weekend but comes to Pittsburgh every other weekend. I am the primary care giver.

Ok, so he needs to file in Pittsburgh. He is probably just blowing smoke. Until he actually files, I wouldn't worry more about it.

That's what my husband said I mean if I felt he really needed it I would by all means go along with it but the school is Willing and able to help. He made the national honor society last year and scored advanced in math on his pssa at the end of last year. This is just is first semester in a new grade. I'm sure he will do better. I was just telling him that we should wait and see what the school can do before spending the extra money. You and my hubby are probably right. I will leave it alone.
