We've been married for 4yrs. We both owned houses before marriage. I rented "mine" out and we lived in "his". Are the houses marital or separate under NC law? I've tried to research on the net but can't come to a definite conclusion. My realtor told me we split both homes. Somebody help!

In most cases you will keep yours, and he will keep his, first your realtor is not a lawer, you need to talk to a lawyer.

In divorce court people ask for any and everything, heck you can ask for it all, don't mean you will get it, what you need to do is first see if you and the soon to be ex can just agree on separation of property, if you both agree, the attorney writes it up that way and that is how it is, there is no problem if you both agree, it is when you don't agree the issues start.

Thank you Fr_Chuck! (my hubby's name is chuck) the problem is that his mother is (and always has been) telling him what to do. I just want to make sure things are done fairly! I'm sure he (she) wants to make sure I come out with as little as possible! Thanks for answering me though!
