    Lease unsigned by landlord
    My landlord never signed my 10-month lease and says that he does not have to because the lease is for less than a year. There is no place for him to sign the lease. It is my understanding that if the landlord does not sign a written lease, it is a month-to-month agreement and may be terminated with 30 days notice. I gave 30 days written notice several months ago, moved out, and stopped paying rent. Now the landlord is calling and harassing me. I am taking him to small claims court to get my security deposit back which he has applied to "unpaid rent." I had a roommate who stayed in the aprtment and the landlord is not harassing her for more rent. What are my chances of winning in small claims court?

    I am a bit confused. He provided the lease but did not sign it? Did you sign the lease and what was the term. He can not seize your security deposit as unpaid rent but you will need to sue him to get it back.
