    Per diem and commission.
    I get paid a % of the gross amount of business I earn. My employer deducts per diem amounts from my gross amount of business earned, this lowering the amount of gross I'm paid on. Is it legal for him to deduct per diem from my gross, when the customer is also being charged for per diem ? I feel like since the customer is being charged for the same per diem being deducted from my gross, that he is double dipping. Thanks.

    This is not subject to law but to your contract or employment policy.

    There is no employment contract, so does that mean he can do it?

    As long as it is company policy and he treats you the same as all other commissioned employees than yes.

    Who is paying for all of the travel, hotel, and food, ( I assume that is the per Diem you are discussing ?
