Myself and my husband fight constantly, we don't get along anymore. I don't think I'm no longer in love with him!
Problem is that I am from England and my husband NY, I want to go home and be with my family. Now that wouldn't be a problem any other day, but we have a 6m old daughter that I will not be apart from. She is my life and I'm feeling sick to my stomach, thinking that I could be stuck here with my daughter. No money, no family and a risk that my husband could have her taken from me because we are in his country. I don't want to stop him from ever seeing her, but I have only 2 choices when it comes to him- stay miserable here or he will drag me through the courts and tell them that I am an unfit mother so that I will lose my daughter as his family have money and I don't, I am at a loss?? Please help!

You will not be allowed to leave the country with your daughter without a passport. So your best bet is to find a support group to help you fight for custody.

It doesn't matter how much money he and his family have. The courts won't deem you unfit unless there's proof to support it.

You made a child with this man, and both of you have rights to that child. You don't have the right to take her away to another country, anymore than he has the right to do the same to you.

You got to understand, I don't have any family here. I don't have the support I need to move on and start a life for my daughter and myself, I would never just take her back home and never let him see her again. But, I don't know what other option I have??

Ok, understand, you are not leaving the country with the child without a court order of custody to allow it. So start a new life, get a support group for women, move out, file for divorce, file for child support and file for custody.

Get a job here and start making a new life

We DO understand, but this question was asked under the Family Law forum (as it should have been). We have to give you an answer that confirms to the law. And the law will not allow you to take your daughter out of the country without a passport and without the father's permission or full legal custody.

You made a choice to marry this man and have a child with him. You now have to deal with that choice. And that means fighting for full legal custody of your child or giving the child up. That's why I suggested trying to find woman's support groups to help.

We are not unsympathetic to your plight. But we can't tell you you can just leave when you can't.

What everyone is telling you is that you MUST develop those supports here. 1 parent can't get out of the US with a child without permission of the other parent. You also need to get along with him, at least at some minimal level, until you can get a divorce, for the sake of an innocent 6 month old child, who is already aware of fighting.

Tell us where you live if you want, and we can help you find support.
And tell us what he is saying that makes you 'unfit.' Courts really don't take a child from a mother unless she is really at the bottom of the gutter, on drugs and doing crime, or not feeding, or hitting, or locking in closets, etc.
