    F1-OPT not in school the entire tax year help filling out 8843
    At end of 2012 (and currently) I am here on F1 visa and OPT status. I'm indian citizen. I was out of school at the end of 2011 and started working on OPT status in January 2012 and worked all year 2012. (FYI, I've been in USA for less than 3 years) I've prepared my 1040NREZ but I'm stuck on preparing form 8843, I am stuck at
    Part 1 (4(a & b)) what should I put here? No of days present for 2012, 2011 & 2010? (I thought I would not count days present till 5 year for substantial presence!)
    (b) what should I put here?

    Part III (9&10) I was not in the school in 2012, I graduated in dec 2011 and on OPT in 2012 and still on OPT in 2013. So what should I put here?

    2012 will be my first year to file tax return. I have been in us for 3 years and never left USA.
    Please advise.

    Part 1 (4(a & b)) : You do enter the actual number of days you were present in the US (these will be the days excluded from being counted towards the SPT)

    Part II: Do put your university name. The OPT is considered an extension of your academic studies.

    TaxesForAliens has it all correct.

    Note that Form 8843 is an ANNUAL requirement, even if you do NOT file a tax return.

    If you did not submit this form in previous years, do it now. Better late than never.

    So I would put 365 in part 1 4b?
    When I file previous years 8843, do I have to be exact for days or can I just estimate 30 days for month?? Does IRS have say in it?
    I will file 8843 for all previous years in a separate mail as you've suggested in your other posts. Is there any software available that can prepare 8843 with 1040NR?

    One more Question, What do I put in 1040NR's Schedule OI (H) 2010__ 2011__ 2012__ (should it be N/A since I was on F1-OPT)?

    Schedule OI Item J is "Are you filing a return for a trust?".

    The answer is NO.
