Child custody order between cp and np. Exchanged place at police station. The non custodial parent(NP) was returned the child 5hrs early to (CP)custodial parent. The police officer called to the CP If the CP isn't going to be at the police station right away, they're going to let the district attorney (DA) inform about the CP answer. Plus the police officer said that the CP should available anytime if the expected things happens.. I feel like they are threatening the custodial parent. For not doing the favor of non custodial parent. First of all the DA won't handle child custody issue.

The police officer is out of hand here, they should have explained that it was not the proper time to come, to the NP.

Is there a specific department that handles this exchange ? If not, do you have the police officers name or badge number to complain about ?

But you ask to see or talk to the shift commander or Capt and explain to them that the NP violated the order by coming early and that the officer who called you was threatening.

Also, your attorney needs to notify the NP, that if he does that again, you may seek to change custody agreement and visitation agreements to further limit his visits.

In some areas the DA's office does handle custody issues. And yes the officer was out of line. But its rare that a police station, unless in a very small town, would function in this capacity.

Actually no, in Atlanta Georgia, the police station or even the Fire Dept is used as a "safe zone" for the exchange of a child, esp if and when there has been abuse or some fear by one of the parties.

Often it is just done inside the station or even in the parking lot, without any involvement of the actual police. It is just done there as a safe place to meet.

In fact normally the police do not have any actual role in this.

That I can see, but I can't see a parent leaving the child with the police if the parent doing the picking up is not there. Especially, if they are not yet scheduled to be there.

I would think the police would tell the dropping off parent, they have to wait.

No, the parent is never to leave the child, unless there is a special unit for this.. the police should be going after the parent who left the child

I think that's part of the point the OP is making. That the NCP left the child and the police officer called the CP to come pick the child up early. Going so far as the threaten the CP if they didn't.

The police should have required that the NCP stay until the CP came and picked up the child. I don't see an issue with calling the CP to see if they could come early. But the NCP should never have been allowed to leave the child until the CP showed up.

Now if the CP was late, then the CP could be considered in breach of the agreement. And it's a different story.

Nope the NP didn't left the child to a police station.. Plus the child only 3yrs old..

So then why did the police call if the NCP still had the child?

The NOn custodial parents asked to the police officer to contact the CP to pick the child up.
