Earlier this week I was discussed ordinances for exotic animals with my local animal control because I have been researching various species. I emailed him specifically in reference to Bennett's Wallabies. He cited our city ordinance as follows (with the important bits in bold):

"Sec. 8-2-32. Keeping or harboring.
(a)It shall be unlawful to keep, harbor or maintain within the City limits the following:
(1)Any Animal designated by the Texas Department of Health as an animal with a high risk of having Rabies.
(2)Any Wild Animal"

With a "Wild Animal" being defined as: "Those Animals of a wild nature or disposition so as to require to be reclaimed and made tame by art, industry or education, or else must be kept in confinement to be brought within the immediate control of the owner. Without limiting the general definition just stated, this term specifically includes poisonous reptiles, a wolf hybrid, or any non-Domestic animal whose normal body weight at maturity is typically fifteen (15) pounds or more. "

He concluded that on the basis of its weight, it was not legal to own.
My question is, based off this information, would you say that a kinkajou would be legal?

They are legal in Texas but I am looking into local regulations. I am reluctant to contact them again because they were... less than approachable. I have emailed them again anyway, but I'm sort of in a time crunch to get it figured out. I am knowledgeable, responsible, with lots of experience and I know the responsibility associated with these animals.

This is from the Wikipedia page (Kinkajou - Wikipedia, the free encyclopedia) on Kinkajous:

"Kinkajous are mostly gentle pets if obtained when young, but can deliver a sharp bite." It also says that they are "hunted for the pet trade."

Therefore, I would not consider them a wild animal under the regulation cited.
