    International Student didn't fill tax forms
    Hi,

    I was an international students in the past 3 years, from 2003-8 to 2005-12. Now I found that I just filled in the tax return form of 2004 (I didn't get any response of this year by the way). I have no income in 2003, so I thought I didn't need to, and now it seems like that I should fill in 8843. In 2005, I worked part-time for few months of a company, but I didn't receive W-2 from them, and the income was less than $5000. Now I found out the tax problem. I want to ask if there is any way to make up this error (even though I don't think I owe any tax for US government).


    After doing a research on OPT->H1B tax filling questions, I am more confused. So I have to ask you again this similar question on my case:

    On 2006, I started to work on May, using the OPT/F1 status. My company have the Social Security tax and Medicare tax waived from my wage directly during this period. My H1-B was approved around Aug and the official start date of it is Nov, 2006. So, I am now wondering, what form I should fill in? 1040 or 1040NR-EZ or both? If both, should I split my wage into two parts and claim separately in two forms?

    If you have not filed Form 8843 for any year since 2003, get the forms for each year from 1040.com Website and fill them out. Mail the 2003 and 2004 Forms 8843 in b themselves; better late than never.

    Contact the company for 2005 and get a W-2. More than likely, they will issue you a Form 1099-MISC, which means you will have to file Form 1040NR with a Schedule C. Your tax will be less than $200, even with late filing fees. Attach Form 8843 for 2005 with that return.

    For 2006, file Form 1040NR-EZ and Form 8843 one last time.
