The only ways for you to place a lien on property are if:

    (1) You sue the person and win a judgment against them, or

    (2) The owner signs a mortgage showing you as the mortgage holder.

In either case, you will need documentation that you paid for the property. How did this come about?

Any question on law needs to include your general locale as laws vary by area.

    But in general, no.

OP paid X. Then OP discovered that X didn't own it, but land belonged to Y.

If that's the case, neither Y nor Y's property would owe OP.

    Sue X.

    Or

    (3) You file a lawsuit to perfect your claim to the property and at the same time file a lis pendens. But don't do this if you have no real claim to the property, or you could be facing liability for "defamation of title".
