    Can just one spouse file for chapter 13 to stop a judgement
    We did answer the initial judgement by asking for reinstatement and more time the attorney was conversing with us and sent email giving us more time to reinstate and then she filed a judgement by default

    If the debt is in both names, the bankruptcy will not help the second person, and they may continue with the judgement and garnishment against the one who does not file.

    If there is a need for bankruptcy, both should consider filing jointly.
